Bankruptcy Lawyers

Anyone contemplating applying for bankruptcy should first employ the services of a professional bankruptcy lawyer; this will be an extremely stressful time for many people as their whole life is about to change. Owing to the recent changes in the law, filing for bankruptcy preparation does take a little longer but an attorney can complete the process much more quickly and efficiently. Most debtors will find that once this means-testing is over, most of the changes to the law end there, and they will be able to proceed with the application just as did before the changes were introduced.

Insolvency laws in the United States have a certain bankruptcy protection built in, whereby the individual filing for bankruptcy will not, under most circumstances, lose his or her home. In addition to this there are extensive exemptions for clothing, furniture, and personal property.

Of course, some States have made additions to the federal law and this is where your bankruptcy lawyer will be of more assistance if you want to retain the possessions to which you are entitled. The Insolvency law is designed to protect certain things like your house and car. This enables individuals filing for bankruptcy to live and work. There are exceptions if high value items are available that can be used to help clear debts.

You may have heard that bankruptcy stays in your credit history file for ten years and whilst that is true, it’s not the whole story. The truth is that your credit score is more greatly influenced by recent credit activities rather than on transactions that have occurred in the past. You will notice within a short period of time after your bankruptcy has been filed that applications for credit are already forthcoming.

There are a number of unscrupulous companies that will wish to give you credit. The rates they want to charge will be much higher than normal and there may also be additional charges. If you are not careful, you could find yourself in debt once again. Do take advice from your bankruptcy lawyer. That does not mean you cannot accept credit but you should be judicious about what types of credit you take on, to ensure payments can be met comfortably.

For careful individuals, this credit rebuild can be as little as two to four years providing everything is kept up to date. Sure, the bankruptcy will still appear on your credit report, but if your current credit is solid, that’s not likely to keep you from buying a home or a car or even obtaining some unsecured credit accounts.

There is now and probably always will be a stigma to bankruptcy. The credit industry quietly fuels this notion as it makes people reluctant to pursue bankruptcy. If this attitude continues, it will just ensure that legislation will become more restrictive. It will therefore become increasingly difficult to apply for bankruptcy. Your bankruptcy lawyer will tell you that the vast majority of people who file for bankruptcy protection are honest, hard working, law abiding people that are just victims of poor fortune and circumstance; they are not criminals who are trying to deceive the State.
